Terms of Service

By using Hit The Mic ("the app") and the website at hitthemic.com ("the site"), operated by Danny Delacruz, you agree to these terms. If you do not agree, please do not use them. Together the app and site are referred to as the "Services".

Use of the Services

Hit The Mic is a karaoke companion app that helps you find and queue songs from YouTube. You may use the Services for personal, non-commercial entertainment purposes only. The app links to videos hosted on YouTube and does not host or distribute any audio or video content itself.

Eligibility

You must be at least 13 years old to use the Services. By using them, you represent that you meet this requirement.

Accounts

You may use the app as a guest or sign in with Apple, Google, or email/password. You are responsible for the security of your account credentials and for activity that occurs under your account. I may suspend or terminate accounts that violate these terms.

Acceptable use

Third-party content

Songs are played via YouTube. By using the app you agree to comply with YouTube's Terms of Service. The app does not host, download, or store any video or audio content.

Audio playback controls

Where available, the app provides optional, user-controlled audio adjustments — including key (pitch) and reverb — that process audio in real time on your device while content plays, comparable to a graphic equalizer or an external effects unit connected to a home audio system. These controls do not download, copy, record, store, or redistribute any content, and do not create, save, or transmit any modified version of any video or recording. All adjustments are temporary and exist only during playback on your device; the original content remains hosted by YouTube and is unaffected.

Spotify integration

You can import a public Spotify playlist by sharing its link into the app. This requires no Spotify login; the app reads only the playlist's public metadata (song titles and artist names) to match against the karaoke catalog, and is subject to Spotify's Terms of Use.

Party Mode

Party Mode lets multiple users, including guests who join from a web browser, contribute to a shared song queue. You agree not to add offensive, harmful, or inappropriate content. Party sessions are temporary and expire automatically, and I may terminate any session at my discretion.

Intellectual property

The Services, including their design, features, and original content, are owned by Danny Delacruz and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Services without my prior written consent.

Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind. I do not guarantee uninterrupted or error-free operation, or that content or search results will be accurate or complete.

Limitation of liability

To the fullest extent permitted by law, Danny Delacruz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. My total liability for any claim arising from these terms or your use of the Services shall not exceed $100 USD.

Indemnification

You agree to indemnify and hold harmless Danny Delacruz from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these terms.

Termination

I may suspend or terminate your access to the Services at any time, with or without cause or notice. You may stop using the app at any time by deleting it from your device.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts located in California.

Changes

I may update these terms at any time. Continued use of the Services after changes constitutes acceptance of the revised terms.
